Please read these Terms and Conditions (“Terms”) carefully before using our Website. These Terms govern Your access to and use of the Website operated by SCANSPACE HOLDING LTD. They do not govern the purchase of products or services — purchases are governed by our separate Terms of Sale.

The words whose initial letters are capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

Your use of the Website is also subject to our Privacy Policy, which describes how We collect, use and disclose personal data. Please read it carefully before using the Website.

The Company has no control over, and assumes no responsibility for, the content, privacy policies or practices of any third-party websites or services. We advise You to read the terms and privacy policies of any third-party websites or services that You visit.

The Website may display, include, make available or link to content provided by a Third-Party Social Media Service, which is not owned or controlled by the Company and which We do not endorse. Your use of any Third-Party Social Media Service is governed by that service’s own terms and privacy policies.

We may suspend or terminate Your access to the Website if You materially breach these Terms, or where We are required to do so by law. Except where immediate action is necessary (for example, to address a security risk, unlawful activity or a serious breach), We will give You reasonable prior notice.

Termination of access to the Website does not affect any order You have already placed or any rights or obligations that have already accrued, including any right to a refund under our Terms of Sale or under applicable consumer law.

8. Limitation of Liability

Nothing in these Terms excludes or limits the Company’s liability where it would be unlawful to do so. This includes liability for death or personal injury caused by Our negligence, for fraud or fraudulent misrepresentation, and any statutory rights You have as a Consumer that cannot be excluded or limited by agreement.

Subject to the paragraph above, and to the maximum extent permitted by applicable law, the Company shall not be liable for any indirect or consequential loss, or for loss of profits, revenue, data or business, arising out of or in connection with Your use of, or inability to use, the Website.

Where You are a Consumer, We are responsible for foreseeable loss and damage caused by Us, but We are not responsible for any loss or damage that is not foreseeable. This Section does not affect the separate liability provisions that apply to purchases under our Terms of Sale.

9. “As Is” and “As Available”

The Website is provided on an “as is” and “as available” basis. To the maximum extent permitted by applicable law, and without affecting any statutory rights You have as a Consumer, the Company does not warrant that the Website will be uninterrupted, error-free, secure, or free of viruses or other harmful components, or that any defects will be corrected. Nothing in this Section affects the statutory guarantees that apply to products and services purchased through the Website, which are set out in our Terms of Sale.

10. Governing Law

These Terms and Your use of the Website are governed by the laws of Cyprus, excluding its conflict-of-law rules. Where You are a Consumer resident in the European Union or European Economic Area, this choice of law does not deprive You of the protection of mandatory provisions of the law of the country in which You are resident.

11. Disputes Resolution

If You have a concern or dispute about the Website, please first contact Us at info@scanspace.cy so that We can try to resolve it informally.

If We are unable to resolve the matter, You may, where You are a Consumer, refer the dispute to a competent alternative dispute resolution (ADR) body or to the courts. Nothing in these Terms limits Your right to bring proceedings in the courts of the country in which You are resident, where applicable law so provides.

Note: the EU Online Dispute Resolution (ODR) platform was discontinued on 20 July 2025, so We do not provide a link to it. Do not add an ODR link anywhere on the Website.

12. Sanctions and Export Compliance

You represent that You are not located in, and will not use the Website on behalf of any person located in, a country or territory subject to comprehensive sanctions imposed by the European Union, the United Nations or the Republic of Cyprus, and that You are not a person with whom dealings are prohibited under such sanctions.

13. Severability and Waiver

Severability

If any provision of these Terms is held to be unenforceable or invalid, that provision will be changed and interpreted to accomplish its objectives to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

Waiver

The failure to exercise a right or to require performance of an obligation under these Terms shall not affect a party’s ability to exercise that right or require performance at any later time, nor shall a waiver of a breach constitute a waiver of any subsequent breach.

14. Language

These Terms may be made available in more than one language. Where You are a Consumer, the version in the language in which the contract was concluded with You, and any mandatory protections of the language of Your country of residence, apply. For other users, the English version prevails in the event of any inconsistency.

15. Changes to these Terms

We may modify these Terms from time to time. If a change is material, We will make reasonable efforts to provide at least 30 days’ notice before the new Terms take effect, for example by posting a notice on the Website or notifying You by email. By continuing to use the Website after the changes take effect, You agree to be bound by the revised Terms. Any purchase You have already made is governed by the Terms of Sale in force at the time of that purchase.
